Following are several questions about the litigation that were asked of TWU100R, and answered by Julio Rivera:
1-Will the attorney be requesting an extension in the case to obtain additional affidavits?
A-Yes
2- Were additional affidavits received this week, on top of the nine previously shared?[Note: The affidavits will be published soon, once personal identifying info has been removed]
A-Yes
3- Have you been able to contact additional retired union members? It looks like your group has about 650 members in your private group on Facebook so far. Is that accurate?
A-Yes
4-Can you please also make a statement regarding the merits of the lawsuit, and how your contract is being violated by the proposed changes?
A-The [union] has replaced Traditional Medicare with a severely diminished benefit: AETNA Medicare Advantage. [This is] a violation of our contract and our state constitution.
5- Will your group be hosting any events to solicit new members? Have you had success reaching the children of the retired transit union workers, who may be more internet savvy and able to find your group?
A-Yes, we are getting more support.
The latest update from TWU100R is before:
To all Retired TWU and transit workers:
Our attorney will be amending the previously filed petition, and will file an amended brief on Friday. The new affidavits we received strengthen our case, so when we amend our court filings, we will include them. It will take a little time to be reviewed, so we will update you when we have more information.
We have received affidavits that describe extremely serious situations. We are seeking more affidavits to file.
If you have a situation where your doctor or hospital are not accepting this plan, you have been denied a treatment or service, or delayed because of prior authorization, we need an affidavit from you! We will take the time to document all of these atrocities so that an accurate report of the irreparable harm can be obtained, and presented in court.
Please reach out to our board to file one immediately.
