Staten Island Politicians Weigh In On Plea Deal Agreement For Migrant Attacker Of Police In Times Square

Staten Island politicians are dissatisfied with the plea deal given to a migrant who allegedly kicked a police officer during a scuffle in Times Square. 
Editor’s note: According to the NY Post: “Darwin Andres Gomez-Izquiel, 19, will face up to one year on Rikers Island in exchange for pleading guilty to second-degree assault in the caught-on-camera Jan. 27 scuffle between two cops and a group of migrants.”

Police Benevolent Association President Patrick Hendry said in a statement: “The sentence should absolutely be longer, but we’re glad that this individual is pleading guilty to a felony and will continue serving time for this brazen attack on our brothers.  However, the important test will come once his sentence is up. He needs to be deported immediately upon release, without setting another foot on our city streets.”

Earlier this year, we were once again reminded of the right to shelter migrant crisis in New York City when a group of illegal migrants pummeled two New York City police officers in Times Square.
On January 31st, we called out this brazen attack, and called for the perpetrators to be charged to the fullest extent of the law and to be deported immediately. One of the perpetrators just accepted a felony plea deal and will serve a year in jail, and to that, we say “good.”
However, we are left to wonder what will happen to him when he completes his sentence, as well as the other migrants who participated in the attack. If the past is anything to go by, it seems likely that following their sentences, these migrants would be left to return to our streets to carry out further crimes.
The only course of action that would adequately punish the perpetrators, achieve justice for this heinous crime, and restore a sense of sanity to this City is to deport this criminal and the other migrants who committed the attack.
Malliotakis: Bragg is Shielding Cop Attacker from Deportation

(NEW YORK, NY) – Congresswoman Nicole Malliotakis (NY-11) released the following statement regarding Manhattan District Attorney Alvin Bragg offering a plea deal to a teen migrant who assaulted two NYPD officers in Times Square:

“I strongly believe that Alvin Bragg intentionally handed Darwin Gomez-Izquiel, the illegal immigrant who assaulted a police officer and lieutenant in Times Square in January of this year, a 364-day sentence to prevent his deportation. This is a slap in the face to all New Yorkers, as under federal law, any illegal immigrant convicted of a crime punishable by a sentence of one year or more must be deported. A Class D violent felony such as this should have resulted in at least a two-year sentence. The judge should ensure that any plea deal includes deportation following the sentence being served. We must stay vigilant and continue to work with the New York City Police Benevolent Association and U.S. Immigration and Customs Enforcement to ensure he is deported after serving his sentence because Albany Democrats and left-wing prosecutors have gone out of their way to change laws and cut plea deals to protect illegal immigrants who commit crimes.

“Alvin Bragg’s intention is similar to when Governor Cuomo and Albany Democrats passed the One Day to Protect New Yorkers Act in 2019, which reduced the maximum sentence for class A misdemeanor offenses in New York State from one year to 364 days to protect illegal immigrants convicted of misdemeanor offenses.”
