New Jersey Federal Judge Also Refuses Injunction – Congestion Pricing In Effect Yesterday

Malliotakis on Congestion Pricing: “We will continue to relentlessly fight this unfair tax on commuters”

Editor’s note: We also covered BP Fossella’s statement on the New York judge’s decision to refuse to grant a temporary injunction in that case.  And after the election, they both made statements on the political motivation for pausing congestion pricing after the announcement it would be going into effect after all. 

It should be mentioned that, in a similar way to the refusal to grant an injunction for the Graniteville Wetlands by a judge, this can mean that the judge does not believe the case has merit, and they will not rule in favor of the politicians and against the city.  Both BP Fossella and Rep. Malliotakis have expressed optimism that President Trump, who is also reported as being against congestion pricing, will cause this practice to be unlawful, likely through an executive order. 

(NEW YORK, NY) – Congresswoman Nicole Malliotakis today released the following statement after a Federal Judge in New Jersey refused to issue an injunction to halt New York City’s Congestion Pricing plan scheduled to begin tomorrow:

“Unfortunately, yesterday Federal Judge Leon Gordon did not grant a temporary injunction to halt the congestion cash grab that starts tomorrow. We will continue to relentlessly fight this unfair tax on commuters and will have our days in court in both New York and New Jersey as we explore our options to stop the Hochul-MTA scheme from the federal level, although the best solution is for the state legislature to undo the mess they created. Last week, I spoke with incoming President Trump who is just as opposed to congestion pricing as we are and he understands the negative impact this new tax will have on residents and our economy. We will continue to use every option at our disposal to stop this unjust invasion of New Yorkers’ wallets. If Governor Hochul actually wants commuters to ride our subways, she should focus on making public transportation safe instead of taxing commuters into submission with this unfair congestion pricing scheme.”

Malliotakis is a plaintiff in one of the ongoing lawsuits against Congestion Pricing with UFT and Staten Island Borough President Vito Fossella. The Federal Judge in that case denied an injunction on December 23, 2024

Congresswoman Nicole Malliotakis

Congresswoman Nicole Malliotakis was sworn in on January 3, 2021 to represent Staten Island and Southern Brooklyn. Prior to serving in the U.S. House of Representatives, Congresswoman Nicole Malliotakis was elected to the New York State Assembly on November 2, 2010, defeating a two-term incumbent. In the Assembly, she served as Minority Whip and the ranking minority member of the Assembly Committee on Governmental Employees.
