Editor’s note: We recently featured an article by this firm’s lead attorney on the case against the closing of multiple shops around the city who were not involved in any illegal activity.  Instead, they were selling federally regulated and licensed CBD, which has no psychoactive component and can treat various health conditions including childhood seizures.  The Supreme Court in New York has sided with the shops, ordering them reopened.  The City newspaper also featured a discussion about how this cannabis shop situation was exacerbated by predatory lending agreements, leading politicians to call for an investigation.

Bauchner has significant experience working with New York’s hemp industry. Most recently, he represented a group of State-licensed hemp operators subjected to warrantless, armed raids. Bauchner’s clients in Smoke n Save LLC, et al. v. NYS CCB, et al., Index No. 908421-24 prevailed when a Court decided that these raids were unconstitutional in violation of the Fourth Amendment (which prohibits searches and seizures conducted without a warrant). These raids had been part of a dragnet targeting unlicensed marijuana stores, but licensed hemp retailers – often small family-owned businesses – were being targeted.

 

 

 

“My hope is that a united front fostered by NYAHAA will strengthen public awareness and education about hemp, dispelling myths and create a more receptive market,” Bauchner added.
