Bauchner has significant experience working with New York’s hemp industry. Most recently, he represented a group of State-licensed hemp operators subjected to warrantless, armed raids. Bauchner’s clients in Smoke n Save LLC, et al. v. NYS CCB, et al., Index No. 908421-24 prevailed when a Court decided that these raids were unconstitutional in violation of the Fourth Amendment (which prohibits searches and seizures conducted without a warrant). These raids had been part of a dragnet targeting unlicensed marijuana stores, but licensed hemp retailers – often small family-owned businesses – were being targeted.
“My hope is that a united front fostered by NYAHAA will strengthen public awareness and education about hemp, dispelling myths and create a more receptive market,” Bauchner added.
