Staten Island, NYC Residents Prevail In Court Over Pied-a-Terre Tax: Latest Ruling Forces Pause

“We’re gratified that the court has recognized we were right all along. The fact is that this administration failed to follow state law when it burdened New York City homeowners with proving they live in their own homes or be on the hook for paying a new surcharge.
Now the administration must go back and do what it should have done from the start: use all the information at its disposal to make an individualized ‘initial determination’ about who truly owes this surcharge before demanding that they pay it.
It’s a shame that it took a lawsuit to get this administration to do the right thing. In short, City Hall botched this rollout and should have just admitted the errors and fixed its own mistake, instead of wasting time and taxpayer dollars by fighting it in court. But now, thanks to this decision, it will have to do it right by the New Yorkers it has wronged.”
A Statement from Borough President Vito Fossella on Recent Ruling Against Pied-a-Terre Tax Rollout
Staten Island, NY – Borough President Vito Fossella issued the following statement regarding today’s ruling in the pied-a-terre tax lawsuit:
“We strongly agree with the ruling from Judge Ozzi against the City’s rollout of the pied-a-terre luxury second home tax list.
We have said from the beginning that it was fundamentally wrong to put more than a million people on this “enemies list”. And, the vast majority of those who were on the list did not belong at all.
In being irresponsible and arbitrary, the City artificially created an atmosphere of confusion and fear about receiving this tax, and their information being wrongfully exposed, for no good reason.
After doubling down countless times and leaving the erroneous list up for months, at a minimum, the City should apologize for needlessly putting hundreds of thousands of people in distress.
The ball is now in the City’s court to do right by the people it unnecessarily harmed, and to put an end to this attack on innocent people.”
