NYC Mayor’s Office Roundtable of Proposed Zoning Updates Which Include Accessory Dwelling Units, Shared Housing Being Allowed To Share Facilities, and Other Components of the “City of Yes For Housing Opportunity” Plan

According to the NYC DCP:

City of Yes for Housing Opportunity is a citywide zoning text amendment that would update New York City’s zoning to allow a little more housing in every neighborhood. Major components of the proposal include:

  • Lifting arbitrary and costly parking mandates for new residential construction
  • Adoption of a Universal Affordability Preference
  • Transit-oriented development and Town Center zoning
  • Allowing homeowners to add accessory dwelling units (homes like backyard cottages)

If adopted, DCP estimates the proposal would enable as many as 108,850 additional homes over the next 15 years.

The proposal was referred for public review in April, and the majority of New York’s community boards and borough presidents have offered their recommendations in support of the plan. On July 10, CPC held a public hearing with a majority of the attendees testifying in favor of the proposal. The CPC is anticipated to vote on the proposal in September. If approved, it will be considered by the entire City Council before the end of the year.

The following questions were asked to the Department of City Planning after the roundtable event.  They are also displayed in the video.  

Accessory  Dwelling Units: Are there any examples of neighborhoods in Staten Island the city is looking at where the accessory dwelling units would be appropriate and encouraged?  
We are proposing to legalize ADUs for all one- and two- family properties, which includes much of Staten Island, but evidence from elsewhere and our own environmental review estimate about a 5% takeup of homeowners actually choosing to add an ADU. The choice to add this space would ultimately be up to individual families – a choice we think they should have – but whether it is appropriate or helpful would be made on a homeowner-by-homeowner basis, rather than by neighborhood. (I would also add that we are proposing additional restrictions on ADUs, especially sub-grade ADUs like basement apartments, in places with greater flood risk.)
Small and Shared housing:  Will the shared housing still require separate bathroom and shower facilities, or is that one of the possible shared amenities (and if so will there be a maximum number of apts per bathroom)? 
Just to start: we are proposing to allow housing with shared facilities only in areas zoned for multifamily residential use, so this would not apply in Staten Island’s one- and two-family districts. But within areas covered by this proposal, yes, bathroom and shower facilities could be shared across units, much like they are today in 2+ bedroom apartments shared by roommates. There would be rules about the number and distribution of shared facilities like bathrooms, but those rules would be in the Housing Maintenance Code (a different set of regulations, outside of zoning) and we are working with our city partners to develop those rules.
